Installation Responsibility

Professional installation by a qualified mechanic or technician is strongly recommended. Improper installation of aftermarket performance components may result in vehicle damage, component failure, reduced vehicle performance, or potential safety hazards.

The installer and vehicle owner are solely responsible for ensuring that products are installed correctly and in accordance with any provided instructions and accepted mechanical practices. Appropriate tools, equipment, and safety procedures should always be used.

Evolution Powersports, LLC is not responsible for damage, injury, or loss resulting from improper installation, misuse, modification, failure to follow recommended installation procedures, or operation of the vehicle after installation.

The vehicle owner and installer are responsible for ensuring that the vehicle is in proper mechanical condition before installing aftermarket performance components.

ECU / Calibration / Tuning Disclaimer

Certain Evolution Powersports, LLC products and services may include electronic control unit (ECU) calibrations, software, or tuning modifications intended to alter engine control strategies, vehicle performance parameters, or other vehicle operating characteristics.

ECU tuning and calibration modifications may alter factory engine management settings and may affect vehicle emissions, noise output, fuel consumption, reliability, and overall vehicle operation.

• ECU calibrations and tuning products modify factory vehicle control systems and may alter the operation of emissions-related components or vehicle performance characteristics.
• The purchaser and vehicle owner are solely responsible for ensuring that installation and use of ECU tuning products comply with all applicable federal, state, and local laws and regulations, including emissions and noise regulations.
• ECU modifications may void the vehicle manufacturer’s warranty and may affect vehicle durability or service requirements.
• Evolution Powersports, LLC does not guarantee compatibility with all vehicle configurations, aftermarket components, or modifications.
• The vehicle owner assumes all risk and liability associated with the installation and use of ECU tuning products or calibrations.

Improper use of ECU tuning products or operation of a modified vehicle may result in vehicle damage, loss of powertrain protection features, or unsafe vehicle operation.

Evolution Powersports, LLC shall not be responsible for damage, loss, or injury resulting from the installation or use of ECU tuning products, calibrations, or software modifications.

Competition / Regulated Products Disclaimer

Certain products offered by Evolution Powersports, LLC may modify, alter, or replace emissions-related or noise-regulated components and may therefore affect a vehicle’s compliance with federal, state, or local emissions or noise regulations, including those enforced by the United States Environmental Protection Agency (EPA) and the California Air Resources Board (CARB).

Where applicable, products designated or marketed for competition use are intended solely for closed-course, non-road competition or racing vehicles and are not intended for use on vehicles operated on public streets, highways, or other public lands unless specifically stated otherwise.

Such products, when used in competition applications, may qualify for exemption from emissions standards pursuant to 40 C.F.R. § 1051 as provided by 40 C.F.R. § 1051.620, and applicable California law (including California Vehicle Code §§ 27156 and 38391), when installed on EPA-certified, purpose-built, non-road vehicles used exclusively for closed-course competition and not for recreational use or operation on public roads or rights-of-way maintained by and open to the public.

These products are intended for installation on vehicles that are not subject to applicable federal or state emissions or noise standards while used in competition. By purchasing such products, the purchaser represents and warrants that they are intended solely for use on vehicles operated in compliance with applicable competition-use exemptions under federal and/or state law.

Product Changes and Specifications

Evolution Powersports, LLC reserves the right to modify product designs, specifications, materials, or components at any time without prior notice as part of ongoing product development and improvement.

OEM Non-Affiliation

Evolution Powersports, LLC is an independent aftermarket manufacturer and is not affiliated with, endorsed by, or sponsored by any vehicle manufacturer unless explicitly stated otherwise. Vehicle manufacturer names, model names, and trademarks are used solely for identification and compatibility purposes.
