EVP Riding Group Partnership Program Terms

These terms govern participation in the EVP Riding Group Partnership Program offered by Evolution Powersports LLC (“EVP”).

Submitting an application does not guarantee acceptance or create a payment obligation. Participation begins only after EVP approves the riding group, provides its private Program Details and receives confirmation that those Program Details have been accepted by an authorized group representative.

Program Details

Approved riding groups will receive a private EVP Riding Group Partnership Program Details document outlining the group’s specific:

  • Program dates
  • Member pricing and product eligibility
  • Group reward structure and qualifying requirements
  • Preferred labor benefits
  • Approved additional benefits
  • Limitations and renewal requirements

The Program Details are incorporated into these Terms. If the Program Details conflict with these Terms regarding a group-specific benefit or financial term, the Program Details will control.

Program Details are confidential. A riding group may communicate relevant benefits to its verified members but may not publicly post or distribute its rates, thresholds, limits or complete Program Details without EVP’s written permission.

Eligibility and Approval

The program is intended for organized riding groups with verified members.

EVP may review the group’s membership, leadership, activities, event schedule, public presence and overall program fit before approving or renewing participation.

EVP may approve or decline an application at its discretion. Submitting an application does not guarantee that any particular benefit will be offered.

Program Term and Renewal

The group’s Program Start Date, Program End Date and renewal requirements will be stated in its Program Details.

Continuation and renewal may require:

  • An updated member roster
  • Confirmation of current group leadership
  • Review of qualifying program activity
  • Confirmation that the group remains in good standing
  • Acceptance of the current Program Terms and Program Details

Renewal is subject to EVP review and is not automatic.

Member Eligibility and Accounts

Program benefits are available only to verified members included on the riding group’s current roster.

Member benefits are connected to each verified member’s individual EVP account. Benefits are personal to the member and may not be shared, transferred, published or used for resale or commercial purchasing.

The riding group is responsible for providing accurate roster information and notifying EVP when a member is added, removed or no longer eligible.

EVP may request reasonable information to verify membership or investigate suspected misuse.

Member Preferred Pricing

Verified members may receive preferred pricing on eligible EVP products.

Available pricing, product eligibility, exclusions, account requirements and other limitations are defined in the group’s Program Details. Pricing may vary by product and may not be combined with certain promotions or offers.

Member pricing:

  • Applies only to eligible purchases
  • Must be used through the verified member’s account
  • May not be shared with nonmembers
  • May not be used for resale
  • May be adjusted or unavailable on certain products
  • Ends when the member or riding group is no longer eligible

EVP may suspend member pricing if it identifies unauthorized sharing, resale, fraud or other misuse.

Annual Group Rewards

The riding group may become eligible for an annual reward based on qualifying purchases made by verified members.

The applicable reward structure, qualifying threshold, maximum benefit, eligible purchases, calculation method and payment requirements are defined in the group’s Program Details.

Qualifying activity may be adjusted for:

  • Discounts
  • Returns
  • Cancellations
  • Refunds
  • Taxes
  • Shipping
  • Excluded products or services
  • Other adjustments identified in the Program Details

Purchases must be associated with a verified member and riding group within the applicable program period. Purchases that cannot be connected to the group may not be applied retroactively.

Any annual reward is subject to verification, the group remaining in good standing and EVP receiving any required payment or tax information.

Preferred Installation Labor

Verified members may receive preferred labor pricing at EVP’s Somerset, Wisconsin facility.

The applicable rate, eligible services and limitations are defined in the group’s Program Details.

Preferred labor pricing applies to labor charges only unless otherwise stated. Parts, products, taxes, shipping, shop supplies and other charges may be excluded.

All service work remains subject to scheduling, availability and applicable EVP service policies.

Additional Partnership Benefits

Approved riding groups may also be considered for additional benefits, including:

  • Early access to select EVP products
  • Local or remote event support
  • Discounted co-branded merchandise
  • Member product giveaways
  • A designated EVP program contact

Additional benefits are not guaranteed. Availability may depend on group activity, qualifying purchases, location, timing, inventory, staffing, event schedules and EVP approval.

Receiving one additional benefit does not guarantee that the same or other benefits will be available in the future.

Early Product Access and Confidentiality

EVP may provide approved groups or members with early access to products, product announcements or other nonpublic information.

Unless EVP states otherwise in writing, nonpublic information must remain confidential until EVP publicly releases the information or authorizes the group to share it.

Early access may be limited by vehicle fitment, inventory, testing requirements, location or other program considerations.

Member Giveaways

EVP may offer product or promotional giveaways to participating groups or their members.

Giveaway availability, products, eligibility and selection methods will be determined by EVP. A giveaway may initially be described generally and later matched to the selected member’s vehicle using the make, model and year provided on the member roster.

A giveaway is not guaranteed to every group or member and may be subject to separate eligibility rules, releases or promotional terms.

Member Roster and Personal Information

The person submitting the application represents that:

  • They are authorized to apply on behalf of the riding group.
  • Members included in an uploaded roster have authorized the group to share their information with EVP.
  • The submitted information is accurate to the best of their knowledge.
  • The group will provide corrections or removal requests when needed.

EVP may use roster information for:

  • Verifying member and program eligibility
  • Activating member benefits
  • Associating qualifying purchases with the riding group
  • Product and vehicle-fitment matching
  • Event coordination
  • Shipping promotional or giveaway items directly to members
  • Inviting members to receive relevant product-release notifications
  • Administering and evaluating the partnership program

Submitting a roster does not automatically subscribe every member to EVP’s general marketing communications. Marketing consent will be collected separately where appropriate.

Personal information will be handled according to EVP’s Privacy Policy.

Organizer Authorization

The person submitting the application confirms that they are authorized to provide information and make program-related confirmations on behalf of the riding group.

The organizer is responsible for notifying EVP if their authority changes or another person becomes the group’s primary program contact.

EVP Name, Trademarks and Brand Materials

Participation does not give the riding group or its members an unrestricted right to use EVP’s name, logos, trademarks, product images or other brand materials.

Public use of EVP branding, co-branded merchandise or promotional materials requires prior EVP approval.

The riding group and its members may not:

  • Claim to speak or act on EVP’s behalf
  • Enter into an agreement in EVP’s name
  • Create obligations or commitments for EVP
  • Make unauthorized product, performance or warranty claims
  • Alter EVP logos or approved brand materials
  • Use EVP branding in a misleading, unlawful or harmful manner
  • Represent that EVP sponsors an event or activity unless EVP has approved that representation

EVP may require the removal or correction of unapproved materials.

Public Endorsements and Disclosures

If the riding group or a member publicly endorses EVP after receiving preferred pricing, group rewards, free products, early access or other benefits, the relationship with EVP must be clearly disclosed.

Public statements must reflect the person’s honest experience and may not include false, misleading or unsupported claims.

Groups and members are responsible for following applicable advertising, endorsement and platform disclosure requirements.

Program Conduct and Misuse

EVP may suspend benefits, remove individual members or terminate a group’s participation for:

  • Fraudulent or inaccurate roster information
  • Sharing member benefits with ineligible individuals
  • Unauthorized resale or commercial purchasing
  • Manipulation of qualifying purchases
  • Unauthorized use of EVP branding
  • False or misleading product claims
  • Harassment, unlawful conduct or activity that materially harms EVP
  • Breach of confidentiality
  • Violation of these Terms or the group’s Program Details

EVP may review or withhold disputed benefits while suspected misuse is investigated.

Suspension, Termination and Withdrawal

A riding group may withdraw from the program by providing written notice to EVP.

EVP may suspend or terminate participation when the group violates these Terms, misuses program benefits, no longer meets eligibility requirements or engages in conduct that materially harms EVP or the program.

When participation ends:

  • Member benefits may be deactivated.
  • Unused additional benefits may be canceled.
  • EVP branding and confidential materials must no longer be used.
  • Any pending group reward will be handled according to the Program Details and the circumstances of the termination.

Sections concerning confidentiality, intellectual property, data use, public disclosures and prior misuse will continue to apply after participation ends.

Relationship of the Parties

The EVP Riding Group Partnership Program does not create an employment, agency, franchise, joint venture or legal partnership relationship.

Neither the riding group nor its members may bind EVP, make commitments for EVP or create obligations on EVP’s behalf.

Purchases, Installations and Product Policies

All purchases, installations and product use remain subject to EVP’s applicable sales, return, warranty, installation, safety and product policies.

Participation in the program does not modify a product warranty, installation requirement, vehicle-use responsibility or applicable law.

Program benefits have no cash value unless specifically stated in the group’s Program Details.

Program Changes

EVP may update the program, these Terms or available benefits.

Material changes affecting an active group will be communicated to the group’s primary contact. Updated terms will generally apply at renewal unless a change is required by law, addresses misuse or is otherwise accepted during the current program term.

EVP will maintain a version record of the Terms acknowledged by each applicant or participating group.

Privacy and Communications

EVP may contact the applicant and participating group regarding:

  • Application status
  • Program administration
  • Member eligibility
  • Program benefits
  • Qualifying activity
  • Renewal
  • Operational or policy updates

These administrative communications are separate from optional marketing communications.

Applicants and members may separately choose whether to receive promotional emails, general product announcements or other marketing communications.
